Welcome to BookMyFarm (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your use of our website, mobile application, and related services (collectively, the “Platform”).

By accessing or using BookMyFarm, you agree to comply with these Terms. If you do not agree, please discontinue using our Platform.

1. Nature of Our Services

BookMyFarm is an online intermediary platform that connects Hosts (property owners) offering farmhouses, villas, and resorts with Guests (customers) seeking short-term stays or weekend getaways.

We act only as a facilitator for booking, communication, and payment between Hosts and Guests. We do not own, operate, or control any listed properties.

All information about properties — including photos, amenities, descriptions, and prices — is provided by the Host. BookMyFarm does not verify or guarantee the accuracy, completeness, or safety of property information.

By using our services, you acknowledge that BookMyFarm is not a party to any agreement between Host and Guest.

2. Acceptance of Terms

• You confirm that you are at least 18 years old and legally capable of entering into binding agreements.
• You agree to these Terms, our Privacy Policy, and any other policies displayed on our Platform.
• You accept that BookMyFarm may update these Terms at any time without prior notice, and continued use implies acceptance of the revised Terms.

3. Booking and Payments

• All bookings are subject to property availability and Host confirmation.
• Payment (online or offline) is required to confirm a reservation.
• Booking confirmation is considered valid only after full or partial payment and acknowledgment by BookMyFarm or the Host.
• Cancellation and refund policies vary by property and are displayed during booking.
• Additional charges may apply for extra guests, extended stays, or additional services, damages, or misuse.
• BookMyFarm is not liable for refunds or compensations unless the Host explicitly agrees in writing and authorizes such action.

4. Property Owner (Host) Obligations

• Provide accurate and up-to-date property details including pricing, photos, and amenities.
• Maintain the property in safe, hygienic, and operational condition.
• Handle guest check-in/check-out, ID verification, and safety compliance directly.
• Manage any guest disputes or refund claims directly.
• Pay applicable service or commission fees to BookMyFarm as agreed.

Note: BookMyFarm does not collect or verify guest ID proofs. It is entirely the Host’s responsibility to collect and verify required IDs at check-in.

5. Guest Responsibilities & Damage Policy

• Provide accurate booking information and maintain proper conduct during the stay.
• Respect property rules, staff, neighbors, and local laws.
• Report any damages or issues to the Host immediately.
• Take responsibility for any loss, damage, or breakage caused during their stay.

The Host is responsible for inspecting, assessing, and recovering compensation directly from the Guest. BookMyFarm will not be liable for damage disputes or recovery of compensation.

Hosts may choose to collect a refundable security deposit from Guests prior to check-in. BookMyFarm’s role in such matters is limited to communication support only.

6. Refunds, Cancellations, and Disputes

Each property has its own refund and cancellation policy, clearly stated during the booking process. BookMyFarm acts only as an intermediary and does not guarantee refunds for cancellations or complaints. All disputes related to refunds, amenities, or stay experience must be resolved directly between Host and Guest.

7. Limitation of Liability

• BookMyFarm does not own, manage, or operate any listed property.
• We do not guarantee the accuracy of listings, property quality, or amenities.
• We are not responsible for property damage, theft, or accidents.
• BookMyFarm’s total liability, if any, shall not exceed the service fee charged for the affected booking.

8. Use of Platform

You agree to use the Platform responsibly and for lawful purposes only.

• Do not post false, misleading, or fraudulent content.
• Do not interfere with or manipulate property listings or prices.
• Do not copy, scrape, or distribute platform data without permission.
• Do not use automated tools, bots, or scripts to access the Platform.

9. Property Content and Intellectual Property

All property images, content, and descriptions are uploaded by Hosts, who retain ownership but grant BookMyFarm the right to display, promote, and advertise listings on the Platform.

BookMyFarm owns the intellectual property of its brand name, design, and system. Unauthorized use or copying is strictly prohibited.

10. Service Modifications

BookMyFarm may modify, suspend, or discontinue any aspect of its services without prior notice.

11. Force Majeure

BookMyFarm shall not be liable for failure or delay in performing its obligations due to causes beyond its control, including natural disasters, pandemics, government actions, or technical failures.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or the use of BookMyFarm shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat.

13. Termination of Access

BookMyFarm reserves the right to suspend or terminate user access without notice in cases of fraudulent activity, misuse, non-payment, or violation of Terms.

14. Indemnification

You agree to indemnify, defend, and hold harmless BookMyFarm, its employees, directors, and partners from any claim or liability arising out of your use of the Platform or violation of these Terms.
